Terms of Service

1. Acceptance of terms
By accessing or using Stimator (the “Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and authorized to bind your organization. You are responsible for all activity under your account and ensuring your users comply with these terms.
3. Accounts and workspaces
Each workspace is scoped to a single business. You must keep login credentials secure. We may suspend or terminate access for misuse, non-payment, or violation of these terms.
4. Billing and subscriptions
Paid plans renew automatically unless canceled. Fees are non-refundable except where required by law. We may adjust pricing with notice. You authorize us and our payment processors to charge the payment method on file.
5. Customer data and content
You retain ownership of the data and content you submit. You grant us a limited license to process that data to provide and improve the Service. You are responsible for obtaining necessary consents from your customers and end users.
6. Acceptable use
You will not misuse the Service, attempt to gain unauthorized access, interfere with other users, or use the Service to transmit unlawful, infringing, or harmful content. We may throttle or suspend access that harms stability or security.
7. AI and outputs
AI-generated outputs may be inaccurate or incomplete. You are responsible for reviewing outputs before using them with customers. Do not rely on the Service for safety-critical or regulated uses without appropriate human review.
8. Confidentiality and security
We implement reasonable safeguards to protect your data, but no system is perfect. You agree to promptly notify us of any suspected unauthorized access or security incident involving your account.
9. Termination
You may cancel at any time via your account. We may suspend or terminate access for breach, non-payment, or risk to the Service. Upon termination, your right to use the Service stops and certain provisions will survive (including ownership, disclaimers, limitations of liability, and indemnity).
10. Disclaimers
The Service is provided “as is” without warranties of any kind. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by law.
11. Limitation of liability
To the fullest extent permitted by law, Stimator and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our aggregate liability is limited to the fees you paid to us in the three months preceding the claim.
12. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your content, or your violation of these terms or applicable law.
13. Changes to terms
We may update these terms from time to time. Material changes will be communicated via the Service or email. Continued use after changes take effect constitutes acceptance.
14. Governing law
These terms are governed by the laws of the jurisdiction where Stimator is organized, without regard to conflict of law rules. Any disputes will be resolved in the courts located in that jurisdiction, unless otherwise required by law.
